The KIBARDIN.COM website (“the Website”) and related services are made available to you in accordance with the following Terms & Conditions and any other rules posted on the Website. Please read the Terms & Conditions carefully before placing any orders on www.kibardindesign.com. We recommend that you keep a copy of the Terms & Conditions for future reference.

By accessing, browsing, using or registering with the Website, you confirm that you have read, understood and agreed to these Terms & Conditions in their entirety. If you do not agree to these Terms & Conditions in their entirety, you are not permitted to use the Website.

The Website is owned and operated by GARRY TRADE s.r.o. (“the Company”).

GARRY TRADE s.r.o. is a company registered in the Czech Republic (company registration number 27443621) whose registered office is at Plzenska 101/1270, 150 00, Prague, Czech Republic. Our registered Value Added Tax (VAT) number is CZ 27443621.

We wish to draw your attention in particular to our policies relating to the terms of purchase within the Terms & Conditions, and our Privacy Policy. If you are under 16 years of age you must inform your parent or guardian about the Website’s Privacy Policy before you register to use the Website. We reserve the right to accept orders only from persons over 18 years of age.

We may modify the Terms & Conditions from time to time. Please read the Terms & Conditions and check back each time you use the Website. If you do not agree with any and all changes to the Terms & Conditions then you are no longer permitted to use the Website. Any change made after you have placed an order will not affect that order, except when the change is a legal requirement.

CONTRACT

Once payment has been received by us we will confirm that your order has been accepted by sending you an email at the address you provide on your order form. Our acceptance of your order brings into existence a legally binding contract between us.

REGISTRATION

You will need to register with us to be able to use some of the services and features made available on the Website. When registering you are required to provide information about yourself that is true, accurate, current, and complete in all respects. You can change your registration information at any time by accessing your “Account” page after signing in.

PRICES

The prices payable for goods that you order are as set out in our website. We reserve the right to change prices. You may be required to pay delivery charges at the checkout stage depending on which delivery service you select. We are able to send most of our products overseas, the delivery cost of which will depend on the weight of the item. If your country is not listed, please email info@kibardindesign.com for more information. Delivery times will vary depending on location. For urgent deliveries please email info@kibardindesign.com, preferably before placing your order, and we will endeavor to find the lowest cost courier for you.

TAXES

All purchases from within the EU are charged VAT at 21%. Prices shown on the site are inclusive of VAT. Overseas orders may be subject to import duties and taxes, which are levied once a shipment reaches its destination country. We have no control over additional customs charges and as such, these charges are to be borne and paid by the purchaser.

PRODUCT

We make every effort to ensure that colors on the Website appear as realistic as possible. However, due to the constraints of digital reproduction on different web browsers, we cannot guarantee the exact color depiction. While every care is taken to ensure descriptions and measurements are accurate, some variations may occur. Measurements are approximate and may vary according to the size of the item.

SPECIAL ORDERS

Special order items are nonreturnable, either for credit or for refund, and such orders cannot be canceled once placed on a customer’s behalf. Special order items are clearly noted as such, and customers are required to sign (or click agreement to) a waiver specifying their understanding of, and agreement with, these terms.

CANCELATION

You may cancel your contract with us for the goods you order at any time up to the end of the seventh day from the date of order, provided that your goods have not already been dispatched. To cancel your order you must notify us in writing, citing your name and order reference, either at sales@kibardindesign.com or by post at Trojska 169/427, 171 00 Prague 7, Czech Republic.

We reserve the right to cancel the contract between us if:

  • We have insufficient stock to deliver the goods you have ordered
  • We do not deliver to your area
  • One or more of the goods you ordered was listed at an incorrect price due to a typographical error.

If we do cancel your contract we will notify you by e-mail, and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We shall not be obliged to offer any additional compensation for any disappointment, damages or loss suffered.

If you receive the goods after you have canceled your order then you must return the goods, without unpacking them, at your own cost and risk. Once you have notified us that you are canceling your contract, any sum debited from your credit card minus the delivery costs will be re-credited to your account as soon as possible, provided that the goods in question are returned by you and received by us in the condition they were in when sent to you.

DELIVERY

There are various delivery options available, or if you prefer you can collect the item from our warehouse. We will deliver your order to the delivery address given at the time you place your order. Delivery will be made as soon as possible after your order is accepted, depending on the lead time of the product. You will be notified when the goods come into stock for goods that require ordering, and on dispatch for stock items. You will become the owner of the goods you have ordered when they have been delivered to you and full payment has been received.

Delivery dates acknowledged by the Company are non-binding estimates only, based upon the best available information concerning manufacturers’ lead times and transportation schedules. Estimated delivery dates will be considered as accepted by the buyer unless disagreement is notified to the Company in writing within seven days of order placement. Special delivery conditions requested by the buyer should be given in writing at the time of order placement. These requests will be considered by the Company and if necessary conditions and charges may change accordingly. From the time of delivery or placement into storage all risks for the goods pass to the buyer.

OVERSEAS PURCHASES

We are able to send most of our products overseas, the delivery cost of which will depend on the weight of the item. For urgent deliveries please email info@kibardindesign.com, preferably before placing your order, and we will endeavor to find the lowest cost courier for you.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs permits and paying any import duties if applicable to the import of goods from our site. Further, please be aware that due to the high cost of shipping internationally the cost of delivery and return is not covered by the Company under any circumstances, and purchases are therefore entirely at your own risk.

Shipping rates are calculated automatically based on weight, size and ship-to location. If we are unable to do this at the time of purchase, we will contact you by e-mail with a shipping quote. This is often the case with international shipping, or if an item is oversized. We will not ship until you have approved the quote.

LIABILITY

For cases where the goods we deliver are not what you ordered, are damaged or defective, or the delivery is of an incorrect quantity, we request that you examine the goods as soon as reasonably possible after delivery, and where necessary that you notify us of the problem in writing within 7 days.

If you notify us of a problem while meeting this condition, our obligation will be, at your option:

  • To make good any shortage or non-delivery;
  • To replace or repair any goods that are damaged or defective;
  • To refund to you the amount paid by you for the goods in question.

SECURITY

We accept bank transfers and the following cards: VISA, MasterCard, AmEx (PayPal). The Company does not collect or record any credit or debit card details you may provide when purchasing products from the Website. All information concerning payment card is transmitted through the SSL protocol and therefore secured against misuse.

Our shop uses the payment gateway supplied by Global Payments Europe. This gateway allows retailers and traders to accept MasterCard and VISA cards during on-line transactions. International associations have introduced a standard known as 3-D Secure for the unique identification of all parties involved in any on-line transaction. The security of the Global Payments web pay system is enhanced by a digital signature attached to all data transferred between the payment gateway and the on-line shop.
